We understand that in most cases the threat of a jury trial is the ultimate leverage in negotiation. Therefore, it is important that our adversaries understand that we are respected trial lawyers who do not shy from the courtroom. Although predicting jury behavior can be an inexact science, we use our extensive trial experience to forecast how a jury might ultimately decide each case we defend. We then make our investigative recommendations to our clients in addition to our recommendations on settlement value. The ultimate goal is to anticipate every potential issue at trial, effectively value each case on the front end and advise our clients of developments that may affect the outcome of the case and its value. This allows our clients to make informed decisions about cost-effective investigative steps to undertake through discovery and to decide which cases should be tried. If a case is suited for settlement our experience of consistently trying cases provides the leverage of a jury trial to our clients’ advantage during negotiations.
